U.S. Rep. Nathan Deal of Georgia wants to change a federal policy that automatically grants citizenship to any baby born on U.S. soil.
The Associated Press reports that Deal, a Republican candidate for governor, and his supporters feel the current policy encourages illegal immigration and makes immigration enforcement more difficult.
"This is a sensible, overdue measure that closes a clause that was never meant to be a loophole," said Bob Dane, spokesman for the Federation for American Immigration Reform, which seeks tighter immigration restrictions.
The term “anchor babies” is often used by opponents of illegal immigration who say immigrant families have children in the United States to establish a legal foothold. The children could also later sponsor citizenship for family members.
Automatic citizenship is part of the 14th Amendment of the Constitution. It says:
“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside."
It’s no surprise that Deal’s proposition has raised concerns among Latino advocates and human-rights groups who say it contradicts the American spirit.
Lisa Navarrete, vice president of the National Council of La Raza, a Hispanic advocacy group, told the AP that the proposed law wouldn't stem illegal immigration and would make the problem worse because not only would illegal immigrants be undocumented, their American-born children would be, too.
"You end up with potentially millions of children who are stateless, who were born here and have no ties to any other country, yet they're not considered citizens or part of the United States," she said.
It's very difficult to amend the constitution. In once scenario, an amendment must be proposed by a two-thirds vote in each house of Congress. If approved, it must be ratified by majority votes in the legislatures or conventions of three-fourths of the states before it can become part of the Constitution.
A recent study the Pew Hispanic Center found that the number of American children who have at least one undocumented parent has increased considerably from 2.7 million in 2003 to 4 million in 2008. More than 70 percent of all children of illegal immigrants are American citizens.
Those children would not lose their citizenship under Deal’s proposal but the numbers demonstrate the rapid demographic shift taking place within the country’s undocumented population.

This is way overdue. That is why you see so many Hispanic women that are pregnant with 3 or 4 more hovering around. Tax payers are paying for their births. That is why most Americans are not having families because they can't afford the medical costs that they are expected to pay. If this is not changed, you will see the Hispanic population become the majority in 15-20 years.

Because if the authors of the 14th Amendment had meant for ANY "anchor baby" to be a US citizen, it would have been sufficient for them to just have the birth language and NOT include "subject to the jurisdiction thereof".
It seems to me that "subject to the jurisdiction thereof" means that the baby cannot be a citizen of another country as well. And since nearly every country has a provision in their law or Constitution that says if a mother and father of that country have a child born abroad, the baby is the citizen of the "motherland".
In other words if a French couple give birth in the US, the baby is automatically French citizen. If a Mexican couple give birth in the US, the baby is automatically a Mexican citizen. NOT an American citizen.
So Franco, give us YOUR take on "subject to the jurisdiction thereof".

The current practice is encouraging more Mexicans to get over the border and produce like rabbits. Once they have planted their seeds, it gives them more leverage of becoming citizens themselves. This is simply an invasion that needs to be stopped or we will be facing serious consequences!
ReplyDeletei completely agree with anon at 1:53pm. i had a family member that was born in south american while her parent was working there -- she is an american citizen not colombian. why is it if you are in america it does not matter what your parents are - french, mexican etc -- the baby is automatically american? that is crazy and why so many illegals are having kids. then when the parents are caught and to be deported they pull the heartstrings about the kids....send them all back!

They have mass quantities of babies for free, and then those babies are educated for free while the parents do not pay into the system. Something needs to change because too many illegals are taking advantage of us. It is out of control.

While I try to ponder the implications of your argument, I think there is a body of established agreements relating to children born with dual citizenships we'd have to work our way out from. Also, there's just something jarring about not granting citizenship to native-born Americans. I don't know that any of my ancestors did anything to become US citizens. We've just been born here for 250+ years..
The reason this law won't change is because these politicians rely heavily on the Hispanic vote. They are not serving the best interest of the country, only themselves. The majority of people in the U.S. agree on this same issue so how does a small group of politicians keep getting elected!

So why would a foreign couple giving birth in the US expect their child to be an American and not a citizen of their native land?
Steve, our ancestors came here for a better way of life and sacrificed to do so. The difference is they wanted to be a part of this country and conformed to it. The Mexicans coming here do not want to learn our customs but change them. They refuse to learn the language and why should they, knowing once they become the majority they will just expand Mexico into Northern Mexico.

Sadly, this makes so much sense it will never happen. So all these kids will continue going to our public schools, taking advantage of our programs and resources, while their illegal parents do not pay into the tax system to provide these services. Our schools are completely maxed out - having to print forms, posters, tests, etc., in both Spanish and English, having to provide ESL teachers for those who don't speak English - and having to have translators at any school or teacher meeting because the parents aren't bothering to learn the language that the kids speak in school. We have given our country away and will never be able to get it back.

2:48 - This isn't about Mexicans, this is about the law. There are quite a few illegals coming from other countries (China in particular) that need to be repatriated.
This is not about mexicans - or latinos....honestly it's not really that part of the world that concerns me the most. Korea, Pakistan, Turkey, China - all heading into the US to have babies. ReplyDeleteMy mother has been delivering babies for 35 years at a semi-rural hospital outside NYC....they all know how to stay under the radar, and they all ask the same question within seconds of the baby being born, "how long does it take to process the paperwork and get a birth certificate?" Scary stuff.

ReplyDeleteMost immigrants - legal or otherwise - come to the US to work and earn enough money to support their families. Most immigrants long to become US citizens. They take great risks to come here but are willing to sacrifice their lives for the chance at a better life. These people often work dangerous or physically taxing jobs at ridiculous wages.
At the heart of the matter, these children are born and raised here and should not have to suffer for decisions they cannot control - their parents' legal status.
BTW - immigrants spend money in the US. The buy food, clothing, gas, etc. In the Carolinas, all of these items are taxed. Also - taxes are taken out of the paychecks of illegals immigrants which will not be refunded. It is not a free ride.
Do it! Also, make it retroactive back about 20 years.

ReplyDeleteThe baby should be born into the same nationality of their parents, no matter where they're born. If your born to American parents in France, you should be an American citizen.... just the same as if your parents are Mexican, Canadian, German, etc... you should be a citizen of that country. Then when you become old enough to make your own decisions about your nationality, you can go through the proper channels to become a legal citizen of your adopted country.
I'm so tired of seeing a small army of children following these women in public... with the kicker being... she's pregnant again! This nonsense has got to stop!

I agree with most posts. An anchor baby should be illegal. In Mexico a couple of years ago there were ads in papers promoting the migration of pregnant women. Why? Because it helps Mexico. Stupid Americans pay to support the kid, pay hospital bills, etc. Hell yes. I applaud this. Illegal immigration is not just a "civil infraction" and the elitist Harvard educated Mary Newsome at the Charlotte observer says. It is a crime. We should be at war with these scum.

ReplyDeleteHere is a good example of the invasion taking place. I saw a school somewhere along the Mexican border, I think Arizona where the students hung the Mexican flag over the American flag. I don't think this is a typical immigrant like our ancestors were. They want to take control of this country and they have already started. They laugh at us and say things about us in Spanish while we grin and go about our merry way. They are not stupid and know how to get what they want.

Once this is established, work from the inside out finding and deporting illegals. The government can give GM a huge contract to build MTVs (Mexican Transport Vehicles)for deportion purposes. We cut down on all the medical care we give them, the bases help the local economies, and our border is secure from illegals and terrorists! Sound good!!

ReplyDeleteOK, here is a scenario that really ticked me off last night. I stopped by the grocery on the way home and I go to the shortest line, but it ended up very slow. The lady in line had two little kids, but she was dividing her groceries up so that she could pay for them in four separate purchases. She was giving the cashier a white piece of paper to cover each group. Of course she could not speak English so it went slow. After she checked out I asked the cashier what the white papers were. She told me it was "WIC" and was a subsidy for Women and children. I may be wrong, but I assume this lady was here illegally. It really ticks me off that illegals come here and live off of our taxes for food, school, medical treatments, etc. I recently had to take someone to the emergency room and English speaking people were the definite minority being treated.

But as far as I remember no public funds or taxes from the great american people were used to pay for my baby girl. Actually I had to pay for my bills. And my baby was not an "anchor" at all, her precious smile didn't grant me any visa, green card or citizenship and I'm back in my country.
Glad to know you paid your bills but there are very few who does. My wife is a nurse and she sees it everyday. The hospitals can not deny medical care so if they are treated and use phony id, who gets stuck with the bill? We tax paying Americans!

When this guy ask me if I'm mexican explains why this whole debate bothers me. The fact is most of "illegal" inmigrants are from mexico but I can assure you there are people from all over the world with no proper documentation living in american soil.

In fact most of these undocumented are young people compare to the average of american people, that's why I beleive they are having more babies than the regular american people.
Also people might think , beucause most of the undocumented are from latinamerican countries we all are "illegals". One day a guy asked me for my green card, I told him, -I don't have any green card-, he replied -then you are "illegal", he assumed because I had accent and the way I look I was "illegal" an also because I told him I had no green card when I fact I wasn't "illegal".
I don't wan't to say is that no matter how tall the walls are in the border or if you don't consider anchor babies as american citizens the inmigration problem would be there. I understand why people are upset or worried about this but as long as we have poverty or violence in your neighbord's yard they will be here. Happened with the irish, the italians and now with latinos. How to fix it, that's complex, but band aids could make things a lot worst.
I moved here from Arizona. Hospitals in small towns close to the US-Mexico border had to CLOSE their maternity departments, forcing US mothers to drive hours for care, because those hospitals were overburdened with women from Mexico who had dashed across the border just before they were to give birth to their "anchor babies."

ReplyDeleteI believe that the 14th amendment needs to be re-written to state that BOTH parents must be US citizens (and have documentation to prove it) in order for the offspring to be a US citizen. Otherwise illegal immigrants do whatever they can to cross the border before the baby is born.
Also, I believe ALL ILLEGAL IMMIGRANTS should be deported as soon as possible and they should be forced to take their anchor offspring with them. (We wouldn't want to separate the family now would we?)
Something must be done to prevent illegal immigrants from coming here and multiplying like rabbits just because they think the more children they have on US soil, the less likely they are to be deported.
Bottom line people is:

8:05 - Ok, I will get a 1 way ticket home... that is to Myers Park... and if you haven't notice, Charlotte it is no longer a redneck town, it is becoming a world class city. That's why after living and working in several cities I decided to come home, stay close to family and childhood friends. And, for the record… I’m not 100% in favor of granting US citizenship to children born in the U.S.A. of undocumented/illegal parents. However, I am 100% against the term “anchor” because it is not an anchor whatsoever, more than 18 years have to pass by for the child to be able to “sponsor” their parent - 18 years it is not a free pass. However, I do know several of what you call “anchor” young adults now that have a higher education, hold management positions, are law abiding, taxpaying, contributors of this society, and most important, proud to be American while not forgetting their cultural background, quite the contrary, embracing it. Therefore, like I said, I am on the fence on the discussion at hand.

That comment shows you that local business operators are actually complicit in flaunting the law and exploiting the lack of rights of illegal immigrants. Local businesses are undermining the local economy knowing full-well people will blame the illegals rather than them. As well, they are greedy, taking taxes from illegal employees knowing full well they, the businesses, will never have to remit them to the local government...thus padding their revenue.
People do have dual-citizenships; so, it stands to reason, Mexicans can be both legal Mexicans and legal US citizens. There are lots of Americans who are also legal Canadians. It's not a case of being only one nationality or the other.
This attempt by Deal is all political. What about the ensuing additional expense and negative publicity associated with having to deport entire Mexican families complete with newly born infants snatched right out of hospital nurseries?
Better to resolve the issue of allowing these aliens to obtain proper permission to work and thus, enabling the taxation ( and reporting by employers) of all their earnings. Force employers to pay standard minimum wages to them, as well; that will level the employment field and more Americans will get more of the jobs.
Darn near every immigrant who ever settled in America, came poor with the motivation to work hard and make a simple living. The Mexicans are no different. Instead of seeking to rid the USA of them, figure out how to assimilate them to the benefit of the US.

The bottom line America has only been America for 500 yrs and was founded by European white caucasoid real Latinos not the adopted Asian mongoloid peasant red race type illegals from what is now Mexico since 1821 being New Spain for 350 yrs before that and the land of the aztec indians before that who originated from Asia.

Stop the invasion. One good way of stopping the invasion by illegal, resource robbing and job stealing immigrants is to take away their incentives for coming here. Stop giving their children born here automatic citizenship, take that incentive away. Or, if they do have a child here, deport them and let the child come back when he/she turns 18 as an American citizen. Either way, since the government refuses to enforce our laws and protect our borders from invasion- this abuse of our country *must stop* and it must now. Enough is enough.
