U.S.A. vs. Arizona: Read the Suit

The federal government has filed suit to try and stop Arizona's tough new immigration law.

The suit contends that the Arizona law interferes with the federal authority over immigration. The Arizona law set to go in effect later this month allows polices officers to question suspected illegal immigrants about their immigration status.

Here is a copy of the suit posted by Politico.com.

And for comparison, here is a link to the Arizona law.

Not only have they squandered our money on non-enforcement, anchor babies and entitlements, when Arizona starts doing their job for them they use more of our money to try to stop them. Typical liberal, union, socialist mentality… Throw the bums out

Ditto.

And how funny is it that my word verification was "taser?" LOL!

This lawsuit is an embarassment and waste of resources.

Let's get this straight. The Feds are suing Arizona for doing the Fed's job which they refuse to do until they can get the ILLEGALS amnesty to vote Democratic in the next election. Right..... What a "hope and change" talking point! Gotta love our absolutely rouge, constitution stomping Federal goverment!!!!! Is it 2012 yet?

Haven't see you in a while, Franco, you didn't take the 4th off did you?

Why would the Federal Govco sue over a law written word for word from their law? Will they now sue themselves?

If people cannot see this move for what it is, they don't deserve to vote.

The suit is purely political.

Mr. Ordonez consistantly proves by his blog, that it doesn't matter to him whether people are here illegally.

Our borders should be secured and the 12 million illegals who are here should be immediately deported.

Man, I'm really starting to hate the federal government. It's employees are paid better than anybody else and they're now telling us we can't have local cops enforce the law of the land. Dems really blow. We need to get these guys out of office.

Wonder if AZ or even other states have considered filing a counter suit against the administration for failure to enforce immigration laws?

I believe we're hearing the death knells of progressive liberalism in America. Hope it's not too late.

Every Attorney that has signed this document is a trader to the US Constitution and to the American people by not enforcing the immigration laws of our nation!.

I surely see our nation heading toward civil unrest and possibly revolt against our own government over matters as this.

Hey Franco?
Can you post a link to the Arizona law so we can read it also?

OVERWHELMING !

How upside is this? Our federal government is suing a state government who is actually trying to enforce a law that the federal government will not? Obama has to go. Cannot wait until 2012. While we are at it every DEM that is up for reelection in 2010 needs to go first! These people are more in favor of illegal aliens than they are US citizens. This is crazy!!

Thought all you xenophobic conservatives wanted to defend the Constitution and protect its original intent? Try reading the 4th Amendment.

JoshuaMac said...

This is not about protecting illegal aliens. It's about protecting the rule of law. I know we're on opposite sides of the political spectrum, but isn't that important too? Or do all of those "unalienable rights" "endowed by our creator" fly out the window when our creator created us in Mexico?

Study finds that Illegal Aliens cost the US $113 Billion dollars a year. I'm tired of paying for their medical care and schooling when it costs the rest of us. http://www.foxnews.com/us/2010/07/02/immigration-costs-fair-amnesty-educations-costs-reform/

JoshuaMac, since you brought up the 4th Amendment I am curious to hear how you think it applies to this case? It wasn't even mentioned in the lawsuit.

It's not unreasonable to search somebody if you have reason to believe they are committing a crime.

Anonymous said...

JoshuaMac you are one confused person.

First, your bending of the 4th amendment is bizarre at best. You clearly have not bothered to read the Arizona law.

It is illegal to be in the United States without documentation, that goes for everyone. Apparently you have zero regard for current law so why do you care about the Constitution all of a sudden?

There is a process to enter this country legally. If you're going to fight for something, fight to speed up that process or I don't know, fight to change Mexico's government. It is not the responsibility of the US to take you in and care for you, good luck finding that in the Constitution.

Having unalienable rights doesn't give you freedom to break laws whenever you feel like it.

With the government estimating that there are 11,000,000 illegals in the US, this is nothing but political grandstanding. AZ will spend in excess of $2.5Billion is social programs and aid to illegals. The magical savior lied to the Governor regarding troop presence. He simply wants the added voters in years to come. No, I am not a Republican, currently I'm registered as a Democrat. Thanks to the BS in NC that makes it inconvenient to change parties. I am though...INDEPENDENT. Both Bushes, Clinton, and now Obama turned blind eyes to a real problem. We might as well call the border Swiss Cheese.

Homeland security issues a warning that those that might harm us have migrated through South America--Iran, Iraq, Somalia, and Indonesia and yet they fail to do anything. The folks in Mexico are just being used as pawns by both parties. Mexico's economy (both dollars of it) would collapse immediately it the money flowing from the US stopped. Mexico's immigration policy is very severe compared to ours. Folks, we let thousands enter the country every year, legally. It is just common sense that this problem needs to be addressed. Of course, I've said common sense and that couldn't possibly apply to GovCo.

Is a state not allowed to protect itself, the most basic element that all states are charged with.

Good, the job of the Government is to kill any good program or job creation situation in this country.

This will stop this mess before it spreads and helps

Although the 4th amendment does not apply here to those using it as an argument..."Even in the law enforcement context, the State may interfere with an individual's Fourth Amendment interests with less than probable cause and without a warrant if the intrusion is only minimal and is justified by law enforcement purposes. E.g., Michigan State Police Dept v. Sitz, 496 U.S. 444, 450 ('90); Terry v. Ohio, 392 U.S. 1, 20 ('68). "

The problem with illegals grew worse year by 8 years prior to this administration... Nothing was being done then either...
